Do You Need a Sick Cert from Day One in Ireland?
It is the question people search at eight in the morning with a temperature: does one day off really need a doctor? In Ireland the answer depends on which pot of money is paying you, and there are three possibilities.
If you are claiming statutory sick pay: yes, from day one
The Sick Leave Act 2022 requires a medical certificate for any day of statutory sick pay. There is no self-certification window inside the statutory scheme — the entitlement is five days a year at 70% of normal pay capped at €110 a day, and every one of those days needs to be certified. If your employer has its own sick-pay scheme: check the contract
Many Irish employers run occupational sick-pay schemes that are more generous than the statutory floor, and a good number allow two or three self-certified days before a doctor is needed. That is a matter of contract, not law, so the answer lives in your contract of employment or your staff handbook rather than in legislation. Where an employer scheme is at least as favourable as the statutory one, the employer can apply theirs instead of the statutory scheme.
If your handbook says "self-certify up to three days", a one-day absence genuinely does not need a doctor. If it is silent, assume the statutory rules and get certified.
If you are claiming Illness Benefit: certified, but paid from day four
Illness Benefit has three waiting days during which nothing is paid, with payment starting on day four. But the claim itself still needs a Certificate of Incapacity for Work from a GP covering the absence, and that is a different document from the note your employer gets. Can your employer ask for a cert for a single day?
Yes. An employer may set reasonable absence-reporting rules, and requiring certification for any absence — including one day — is within that. What they cannot do is demand your diagnosis. A certificate confirms you are unfit for work and for what period; what is wrong with you stays between you and the doctor.
What to do this morning
Tell your employer you are out, by whatever method your absence policy specifies, and do it early. Check your handbook for a self-certification window. If there is none, or you are relying on statutory sick pay, arrange a consultation for today rather than later in the week — a certificate is far easier to date correctly when the consultation happens while you are actually ill. One thing worth getting right
Date the certificate from the first day of absence, not the day you got around to seeing someone. A doctor can only certify a period they can reasonably stand over, so a same-day consultation gives you the cleanest cover. Waiting until HR chases you on Thursday about Monday is how people lose paid days.
